
Warranty & Limitation of Liability
Unless otherwise stated in writing, all repairs and touch-up services are provided without warranty or guarantee.
Kyle's Wood Touch Up And Repair shall not be liable for:
normal wear and tear,
future finish failure,
environmental conditions,
humidity,
temperature fluctuations,
structural movement,
acts of God,
accidental damage,
misuse,
abuse,
or damage caused by third parties or other trades.
Any repairs performed during unsuitable weather conditions at the client's request are completed entirely at the client's risk.
Exterior repairs and finishes are provided without ongoing warranty unless otherwise specified in writing.
Liability, if any, shall be limited solely to the value of the services provided by Kyle's Wood Touch Up And Repair under the applicable invoice or contract.
Under no circumstances shall Kyle's Wood Touch Up And Repair be liable for indirect, incidental, special, or consequential damages.
Existing Conditions & Third-Party Work
Kyle's Wood Touch Up And Repair is responsible only for the specific repair work directly performed by its employees, subcontractors, or authorized representatives.
No responsibility is accepted for:
per-existing defects,
structural deficiencies,
manufacturing defects,
hidden damage,
defective materials,
or damage caused by other contractors, trades persons, occupants, or guests.
Any additional repairs required as a result of damage caused by third parties shall be billed separately.
Floor Repair Clause
Floor repairs are performed on a best-efforts basis only and are not guaranteed.
Kyle's Wood Touch Up And Repair does not warrant against:
finish failure,
flaking,
peeling,
stain variation,
delamination,
recurring movement,
or future wear of repaired flooring surfaces.
Client acknowledges that flooring repairs may remain partially visible depending on material condition, age, lighting, and prior wear patterns.
Acceptance of Terms
Approval of an estimate, quotation, invoice, work order, deposit, or commencement of work constitutes acceptance of these Terms & Conditions.
“Acts of God” wording is common but should not attempt to waive gross negligence.
You cannot fully contract out of negligence in every circumstance.
Courts dislike overly broad liability waivers written unclearly.
“No warranty” clauses should be plainly visible on invoices/contracts.
If you use subcontractors regularly, you should strongly consider carrying commercial liability insurance and referencing it separately.

Product & Workmanship Warranty
Kyle's Wood Touch Up And Repair is committed to providing high-quality workmanship and professional-grade materials whenever possible. While every reasonable effort is made to ensure long-lasting results, certain products and finishes may fail over time due to factors beyond our control.
Manufacturer warranties apply only to products supplied by the original manufacturer. Any product warranty, guarantee, replacement, repair, or refund is solely the responsibility of the manufacturer and is subject to that manufacturer's terms, conditions, exclusions, and warranty periods.
Manufacturer warranties generally cover product defects and functional failures but do not cover:
misuse,
accidental damage,
improper care,
client modifications or alterations,
unauthorized repairs,
environmental conditions,
or normal wear and tear.
Workmanship provided by Kyle's Wood Touch Up And Repair is warranted for a period of sixty (60) days from the date of project completion, covering defects directly related to the workmanship performed.
This workmanship warranty shall be considered void where damage or failure results from:
misuse or abuse,
accidental damage,
improper maintenance,
client alterations or modifications,
unauthorized touch-ups or repairs,
failure to follow verbal or written care instructions,
insufficient curing or drying time,
environmental conditions,
or normal wear and tear.
In the event of a concern or possible failure, the client must notify Kyle's Wood Touch Up And Repair within seven (7) calendar days of first noticing the issue and must follow all reasonable instructions provided to minimize further damage and allow timely inspection and repair.
Failure to provide prompt notice or failure to follow provided instructions may void any applicable workmanship coverage, and any resulting repairs may be completed at the client's expense unless otherwise agreed to in writing.
Kyle's Wood Touch Up And Repair will make reasonable efforts to work cooperatively with clients to achieve fair and practical resolutions where concerns arise.
